At the end of the day - Doc Marten got what they wanted a huge campaign. It is misleading but the company got the people's attn however untasteful it might or might not be. If a lawsuit comes from this I see the ad agency not the shoe company having to fight that- depending on what type of lawyer they both had.
Personal opinion only however...

I like those ads and the whole idea. In our culture of consumerism it is ideal to think about the afterlife and not take one day for granted.

I think the ads have been pulled in the UK. The message is an interesting one. However, the problem remains, they used their iconic images to advertise boots without consent.
