In this mornings paper there was a story about a St Thomas man who was arrested and is facing charges after a 16 year old girl he suspected had broken into his van was hit in the head with a baseball bat&. The girl had to be taken to hospital with a serious head injury needing 5 staples to close&.Sarah and Taz thought that this guy was totally out of line&a few CDs was no reason to confront someone brandishing a weapon&situations like that get out of control..and weather he ment to or not&he almost killed her&.Tucker on the other hand thought this guy was within his full rights to defend his property, and that the girl should be to blame because SHE was breaking into the van and committing a crime&therefore opening herself up to whatever kind retribution the property owner felt was justified in the situation.

Lee said&..I can only speak for London, Ontario. As a witness to a home invasion in October of 2005, that was followed up by a criminal court case here in London in which my roommate and I unfortunately had to testify, I can simply state that, under NO circumstances can one use the term "in self-defense" to justify assault by any means. It does not matter that a man broke into our house and tried to kill the tenants downstairs. It does not matter that from two different phone lines in two different apartments of the same house, we call 9-1-1 a total of EIGHT times before the police cared to show up. It does not matter that the man broke through TWO sets of doors to get into our house. All that matters is that when he got inside, the people inside fought him off as best as they could, HOWEVER, according to the London justice system, they should not have "assaulted him with a weapon."
Cassy wrote&..OMG! I can't believe Tucker actually believes the garbage that's coming out of his mouth. This was not a heat of the moment thing. Yelling out the window is heat of the moment. Grabbing the first available object to throw at someone who catches you off guard in the house is heat of the moment. Running out of the house, stopping to put shoes or slippers on, grab a bat and take off requires forethought. When we are adults we are expected to stop and say to ourselves "what would a grown up do in this situation?" This guy was pissed off (understandably so) but we are not allowed to chase down everyone that pisses us off.
Yvonne said&. I would like to ask Tucker if it would've been ok for the guy to have brought out a gun "just to scare them", then things got out of control and someone was shot. You're right about one thing Tucker-it's tough to make those decisions in the heat of the moment without all of the information. That's why you call the police. Does this girl deserve to have brain injuries because she stole some CD's when she was a teenager?

Alex had to say&The bottom line is the law does not do enough to protect normal people like us. The reason people go around stealing from cars is because there is nothing to stop them, even if they get caught red handed most of the time they can just run away and get away with it so good for the guy for popping her with the mini-bat (theres a big difference between killing someone and hurting them, most of the time there is a very clear difference with very few freak accidents as exceptions)
